Regional Policy Statement

The Bay of Plenty Regional Policy Statement promotes the sustainable management of the Bay of Plenty Region's natural and physical resources.

The sustainable management of the natural and physical resources is promoted in this document by the provision of an overview of the resource management issues of the region with policies and methods to achieve integrated management of natural and physical resources of the whole of the Bay of Plenty Region.

Monitoring and Review of the Operative Bay of Plenty Regional Policy Statement

On 3 November 2005, the Council approved in principle that preparation of a second-generation regional policy statement to supersede the Operative Bay of Plenty Regional Policy Statement would begin in July 2006. 

This is a result of the Resource Management Amendment Act 2005 requiring that regional and district plans ‘give effect’ to the relevant regional policy statement.  Previously regional and district plans could ‘not be inconsistent’ with the regional policy statement.  The Operative Bay of Plenty Regional Policy Statement was not developed with this more directive approach in mind.  Consequently, it is proposed to bring forward preparation of a second-generation regional policy statement to reflect this change in status so as to feed into the development of second generation regional and district plans. 

Prior to this preparation of a second-generation regional policy statement, the Council is to report on its section 35 monitoring of the efficiency and effectiveness of the Operative Regional Policy Statement and to commence a section 79 review of it.  This will take place during 2006.

Environment Bay of Plenty seeks to inform, and provide opportunity for response from, the general public during this review. 

Section 35 of the RMA requires Environment Bay of Plenty to monitor the efficiency and effectiveness of policies, rules or other methods in the Bay of Plenty Regional Policy Statement and to compile and make available to the public a review of the results of that monitoring (RM Amendment Act 2003). 

Section 79 of the RMA requires Environment Bay of Plenty to commence a full review of the Bay of Plenty Regional Policy Statement no later than 10 years after it became operative (the Bay of Plenty RPS became operative on 1 December 1999).  Subsection (3) states: If, after reviewing a policy statement…under this section, a regional council…considers…the statement…requires change or replacement, it shall change or replace the statement…in the manner set out in Schedule 1 and…Part 5.  Subsection (6) states: The obligations of each regional council…under this section are in addition to its duty to monitor under section 35.
